Terms of Service

These Terms of Service govern your use of CustomEditing.com, a subsidiary of Custom Thumbnails, LLC, which may be modified from time to time. It is the client’s obligation to review these terms periodically. Please take a moment to review the following guidelines. 

Please note that CustomEditing.com operates as a subscription-based video editing service tailored to content creators and YouTubers.


Service Workflow and Turnaround Time:

At CustomEditing.com, we work on one video at a time using our Sequential Video Editing process. Once we’ve received all the necessary materials and answered any questions, we aim to deliver the finished video within 1-2 business days. Typically, our turnaround time is 1-2 business days for all drafts and revisions.

When we talk about business days, we mean the days when CustomEditing.com is open for business, usually Monday through Friday from 9 am to 5 pm Mountain Time, excluding major US holidays. Weekends (Saturday and Sunday) and hours after 5 pm Mountain Time during weekdays are not considered business days. Orders placed before 10:00 am Mountain Time on a business day count towards that day. Orders placed after 10:00 am Mountain Time may be processed on the next full business day. We mention this so we can receive footage from our clients as early in the day as possible.

In the event that the client uploads multiple videos, a queue system will be implemented. CustomEditing.com will edit each video sequentially, proceeding to the next only after approval of the current edit.

Our editing process is collaborative. So, timely feedback on draft edits and responses to any questions from our team will help us complete your video as quickly as possible. After delivery, you can give feedback and request revisions mainly through our portal and Frame.io. We offer Unlimited Revisions, meaning we’ll keep refining your video until you’re completely satisfied. Once a video is approved by the client, we’ll move on to the next one in line.


Credit Policy:

Unused credits do not carry over to subsequent billing cycles. For instance, if your plan renews on December 3rd and you had one remaining credit on December 2nd, that unused credit will not get added to your new monthly allocation upon renewal. Your available credits reset with each billing renewal.

This approach encourages consistent content publishing, a cornerstone of success for online creators. Furthermore, it enables us to maintain rigorous quality control by carefully balancing each editor’s workload against the maximum potential videos they can effectively manage per month.


Video Length Guidelines for Long-Form Content:

To ensure an efficient workflow, we have implemented the following video length guidelines:

– Maximum length for the final edited video: 20 minutes (if yours may exceed this, please contact us before placing your request)

– Maximum duration of raw client-provided footage: 45 minutes (if yours may exceed this, please contact us before placing your request)


Video Length Guidelines for Short-Form Content:

To accommodate the unique demands of short-form video platforms like TikTok, Instagram Reels, and YouTube Shorts, we have set specific guidelines:

Maximum Duration of Raw Footage: Raw footage for short-form videos must not exceed 5 minutes. This limit ensures that we can maintain a swift turnaround and high-quality editing standards.

Maximum Length of Final Edited Content: The final edited video for short-form content should not exceed 60 seconds. This duration is tailored to optimize engagement and comply with the platform-specific requirements of short-form video channels.

Clients planning to exceed these limits should contact us at support@customediting.com prior to submission to discuss possible adjustments and approvals.


Credits:

Our credit roll-over policy, coupled with these reasonable length limits, facilitates a seamless creative experience. You’ll collaborate with the same dedicated video editor on every project, fostering a cohesive creative relationship. This systematic approach optimizes your channel’s identity and ensures consistent, professional-quality output.


Editing Services:

We provide basic color correction/grading, a variety of customizable lower thirds/transitions, and access to a library of royalty-free stock video/audio (not exceeding 20% of the total duration). Custom animations may be available for an additional fee, which will be quoted on a per-project basis. However, we do not offer voiceovers, wedding video editing, editing of prank videos that we deem offensive or editing services for explicit content. We have a library of customizable transitions and lower thirds that we can use upon request.

Short-form video clips are available as an add-on service, crafted meticulously by our editors and not generated by AI.


Terms and Conditions:

Intellectual Property Rights:

Clients maintain complete ownership rights over all content they submit, including the final edited video product. CustomEditing.com does not claim any ownership rights over the client’s content, except for a limited non-exclusive license to access and use the content for editing purposes and to showcase the finished video and your YouTube channel or other social media account name in our portfolio or marketing materials.


Confidentiality and Privacy:

CustomEditing.com treats all client data and content as confidential. We do not share or disclose any client information or materials to third parties without explicit consent, except as required by law. However, by using our services, clients grant CustomEditing.com permission to use their name and the videos we have edited for them in our marketing materials and portfolio examples in perpetuity. If a client wishes to opt-out of having their name or video work showcased for marketing purposes, they can submit a request to support@customediting.com.


Acceptable Use Policy:

CustomEditing.com prohibits the upload or submission of any content that is illegal, defamatory, hateful, explicit/obscene, or infringes on intellectual property rights. We reserve the right to refuse service for any content we deem inappropriate or offensive. Prohibited content includes but is not limited to: hate speech, explicit nudity, pornography, illegal activities, and copyrighted material used without permission. We will not edit “prank videos” that appear to be harassing or offensive.  We will not edit wedding videos.


Dispute Resolution:

Any disputes arising from this Agreement shall be resolved through binding arbitration under the rules of the American Arbitration Association. The arbitration shall take place in Ada County, Idaho.


Force Majeure:

CustomEditing.com shall not be liable for any delay or failure to perform due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, acts of war, terrorism, civil unrest, or network/system failures.


Termination:

CustomEditing.com reserves the right to terminate any client’s account or service, with or without notice, for violation of these Terms of Service, failure to make payments, or any other conduct that we deem inappropriate or unlawful.


Indemnification:

Client agrees to indemnify, defend, and hold harmless CustomEditing.com, its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs or expenses (including reasonable attorney’s fees) arising from the client’s use of our services, violation of these Terms, or infringement of any third-party rights.


Warranties and Disclaimers:

CustomEditing.com makes no warranties regarding the quality, accuracy, or completeness of the edited video content or information provided. Our services are provided “as is” without any express or implied warranties. We disclaim any liability for errors, omissions or misrepresentations in the edited video.


Modification of Terms:

CustomEditing.com retains the prerogative to amend or adjust this Agreement and its affiliated policies/guidelines at its sole discretion. By proceeding to checkout and use of our service, you (“Client”) acknowledge acceptance of our Terms. You affirm that you have thoroughly reviewed the operational procedures of our service and its scope. Any modifications will be communicated via our “Terms of Service” link and shall be effective upon the publication of the revised terms. It is incumbent upon you to regularly review any alterations or modifications. Continued utilization of our services subsequent to the posting of changes implies your acceptance of the revised terms. If you disagree with any modification, please discontinue using the services and cancel your account.


Renewal:

Your subscription and any add-ons automatically renew until canceled.


Cancellation:

You may cancel your subscription at any time prior to the conclusion of your current billing period by accessing your account and selecting the cancellation option. Access will persist until the end of your paid term.

Upon cancellation, access to files will be terminated – we advise downloading files locally before initiating cancellation. CustomEditing.com will promptly delete all video files, assets, comments, and notes upon the client’s cancellation.


Refunds:

The Company does not provide credits or refunds for terminated accounts, canceled requests, or canceled orders. Subscriptions and individual credit purchases are not eligible for refunds, except in instances of double billing or other clerical errors. Users must cancel their subscription before renewal to avoid charges. Additionally, all purchases of single credits, regardless of quantity (e.g., non-subscription credit purchases), are ineligible for refunds.


Payment:

Payments are non-refundable except as outlined in the Refunds section. By registering, you authorize CustomEditing.com and Custom Thumbnails, LLC to charge your payment method the applicable fee on each registration anniversary according to your billing frequency. Failure to make payments may result in account suspension, and all associated videos, assets, comments, and notes will be deleted. It is imperative that payment information is accurate and up-to-date. Any changes to payment details should be promptly updated.


Client Satisfaction:

CustomEditing.com endeavors to uphold the highest standards of client satisfaction. Acknowledging the intricacies of the creative process, we are committed to ensuring that your video editing experience surpasses expectations. We invite you to meticulously review the final rendition of your video and promptly communicate any necessary adjustments. Your input is invaluable to us, and we pledge to address your requests expediently, ensuring that the final product aligns precisely with your vision. Your contentment is of paramount importance to us, and we spare no effort in delivering a product that exceeds your expectations.


Pausing Your Subscription:

Clients are accorded the privilege of temporarily suspending their subscription as circumstances necessitate. This discretionary pause feature enables clients to manage their subscription in alignment with their requirements. To exercise this option, clients are advised to access their account settings and utilize the designated pause function. Whether necessitated by short-term exigencies or protracted absences, the pause duration may be customized to accommodate individual needs. CustomEditing.com facilitates this flexibility to ensure an optimal client experience.


Usage of Music Tracks:

Inquiries regarding the utilization of preferred music tracks within videos are addressed within the framework of intellectual property rights. Clients are encouraged to furnish proof of rights ownership for selected tracks, facilitating their incorporation into the video editing process. Our commitment to facilitating client preferences underscores our dedication to providing a tailored editing experience. Subject to the possession of requisite rights, clients may avail themselves of this option, thus enriching their video content with personalized soundtracks.


Complex Projects & Communication:

While we strive to meet your deadlines and accommodate unlimited revisions, some projects may require additional time due to their complexity or volume. We will communicate any potential delays directly to you through our customer portal and keep you informed throughout the editing process.


Client Responsibility for File Backups:

It’s crucial to emphasize that CustomEditing.com is not a data storage company and human errors happen as well as errors during upload / download. Clients must understand and prioritize the need to safeguard their files. Before initiating cancellation of their subscription or at any other time during their engagement with CustomEditing.com, clients are solely responsible for backing up their files. CustomEditing.com will promptly delete all video files, assets, comments, and notes upon the client’s cancellation, and the client acknowledges and accepts this policy.

Despite the raw files being stored in the client’s Google Drive account, an additional backup is required. CustomEditing.com strongly advises clients to maintain backups of their data independently and regularly throughout the subscription period. It’s worth noting that CustomEditing.com would not assume the risk of working with a client if their files were not backed up adequately. The inclusion of this section in the terms of service underscores the importance of file backups, and CustomEditing.com would exercise caution in engaging with clients who did not comply with this requirement.


Limitation of Liability:

CustomEditing.com, its parent company Custom Thumbnails, LLC, and their owners, partners, and managers shall not be held liable for any losses, damages, or expenses incurred by the client or any third party in relation to the use of CustomEditing.com’s services, beyond the cost of service for the current paid month. This includes but is not limited to costs associated with refilming, production, or any other incidental or consequential damages. By engaging with CustomEditing.com’s services, the client explicitly agrees to this limitation of liability and releases CustomEditing.com and its affiliates from any claims arising from file loss or deletion, including accidental deletion or file corruption.

This includes, but is not limited to, offering clients the right to access, correct, delete, or transfer their personal data, and using such data solely for the purposes agreed upon. Our privacy policy, accessible on our website, provides detailed information on how we collect, use, and protect your data, and your rights concerning your data.


Feedback and Complaints Procedure

We value your feedback and aim to resolve any complaints promptly and fairly. If you have specific feedback or a complaint about a video editing request, please leave a comment in the portal under the specific request. This allows us to address your concerns directly related to the service provided. Alternatively, if you have other types of complaints or need assistance, please email us at support@customediting.com. We strive to respond to all queries and complaints work with you to resolve any issues to your satisfaction.


Use of Third-Party Assets

CustomEditing.com utilizes various third-party tools and resources to provide stock images, photos, audio, lower thirds, and other assets that enhance your video content. Should you wish to use the video content we create for you beyond typical YouTube usage, please notify us in advance by emailing support@customediting.com. This ensures compliance with the specific Terms of Service or licensing agreements of the third-party asset providers. Upon your notification, we will provide you with the relevant third-party Terms of Service, which you must review and agree to before using the assets in the described manner.


Governing Law:

Any claim involving CustomEditing.com, Custom Thumbnails, LLC or its partners or managers are subject to the law of the State of Idaho.

 Process for Using CustomEditing.com Services

To ensure a smooth and efficient editing process, please follow the steps outlined below:


  1. Set Up Your Google Drive

– Create Your Project Folder: Name this folder after your project for easy identification.

– Organize with Subfolders: Create a “Raw” folder for unedited videos and an “Edited” folder for completed ones.

– Share Your Project: Provide access to files@customediting.com for file uploads. If you require support, contact support@customediting.com directly.


  1. Submit Editing Request on CustomEditing.com

– Access Your Account: Log in to your client portal on our website.

– Create a New Request: Fill in the details about your project, making sure to link to your “Raw” footage stored in Google Drive.

– Specify Your Needs: Include any special instructions or preferences for the editing team to follow.


  1. Review Drafts on Frame.io

– Receive and Review Draft: You will be notified via Frame.io when a draft of your video is ready for review.

– Feedback Loop: If satisfied, approve the draft in the portal. If edits are needed, annotate directly on Frame.io and inform CustomEditing.com through your request in the portal.


  1. Finalize and Receive Your Edited Content

– Approval: Once you approve the final version, it will be placed in the “Edited” folder in your Google Drive.

– Next Projects: Should you have more videos to edit, we’ll automatically proceed with the next project in your queue.


 Additional Notes

– For More Videos: After approving a video, we will move on to the next project in your queue.

– Starting New Projects: If there are no more projects in the queue, you can simply submit a new request when you’re ready.
